Indemnity & Waiver Agreement:

 

I acting herein for myself and my invitees, including members of my family and dependents, hereby waive and abandon any and all claims of every nature and whether for me personally or in any representative capacity, in respect of any loss, damage, physical injury or death from whatsoever cause or howsoever arising out of any act or omission by the owners of The Cambridge House Halfway House (“the property”), Cambridge House(Pty)Ltd, their employees, officers, agents or consultants (collectively “management”) and their respective invitees and notwithstanding that any such act or omission may arise outside the course and scope of employment of management and their respective invitees. Such waiver, shall, in addition, apply to claims in respect of any loss, damage, physical injury or death arising from my involvement directly or indirectly, in outings or activities sanctioned and/or organised by management and their respective invitees. 

1.      I furthermore indemnify and hold harmless management and their respective invitees, from

2.      time to time, against any loss or damage, whether in respect of capital and/or costs awarded by any court in respect of any loss contemplated in paragraph 1 above, suffered by me or any of my invitees, including members of my family. 

3.      Notwithstanding the foregoing, I undertake at all times to obey immediately and without query any demand or request that may be made to me at any stage in the course of my stay at the property and on any outings or during any activities organised by the management and their invitees and I acknowledge that any such demand or request will be made for the purpose of ensuring my personal safety, alternatively the safety of others in who’s company I may be. 

4.      I acknowledge that management and their respective invitees accept no responsibility and shall not be liable for any loss, damage, physical injury or death from whatsoever cause or howsoever arising which may be sustained by me or my dependents whilst on the property, whether or not same is due to the negligent act or omission of management or their respective invitees and notwithstanding that any such act or omission may arise outside the course and scope of the employment of management. 

5.      I furthermore undertake and agree that this waiver and indemnity shall be effective at all times during my stay at or visits to the property and in respect of all future visits thereto and shall continue to be fully effective and operative until withdrawn from me on 30 (thirty) days written notice to the management. 

6.      I understand that my residence is subject to the approval of management. It is conditional on my adherence to the house rules with which I am familiar, on my general achievement of the expectations of the house rules and on meeting payment of fees. If I violate any of these rules, I could be asked to leave the house by a staff member. Failure to leave peacefully could result in trespassing and further charges being laid against myself. 

7.      I understand and agree that the house is not responsible for any loss or damage to my personal property and I waive any claim or action against, its staff members or management arising out of such loss or damage. In this regard I understand that keeping valuable personal property on the premises is discouraged. 

8.      I acknowledge the members of staff and the management are not responsible for my recovery.  I am responsible for my recovery and hereby waive any claim or action I may have against any member of staff or member of the management or against the institution for my failure to make any recovery from my addiction or alcoholism. 

9.      All decisions will be made to best suit the needs of the resident, as well as ensuring the recovery of all other residents.  

10.   I give permission for staff to make contact with family to obtain collateral information regarding my addiction/alcoholism, as well as to give them feedback on my progress. 

Residents, Guest/s and anyone else entering 26, 26A or 26B Cambridge Road, Bryanston enters at their own risk.  

Cambridge House (Pty) Ltd and its owners, the Proprietor, its agent/s, contractors and/or its employee/s shall not be liable for any claims including but not limited to theft, injury, loss, death or damage of whatever nature, against Cambridge House (Pty) Ltd, and its owners, the Proprietor, its agent/s, contractors and/or its employee/s, whether arising from their default, negligence or otherwise.  

The residents, guest/s and other people entering the premises, hereby waive/s and abandon/s any claims of whatever nature against Cambridge House (Pty) Ltd, Justin Jansen, Damian Maguire, Marina De Wet, Christopher De Wet, and its owners, the Proprietor, its agent/s, contractors and/or its employee/s. 

The residents, guest/s and other people entering the premises, in addition to the aforesaid, hereby indemnify Cambridge House (Pty) Ltd, Justin Jansen, Damian Maguire, Marina De Wet, Christopher De Wet, and its owners, the Proprietor, its agent/s, contractors and/or its employee/s against any claims which may arise from whatever nature, whether arising from their default, negligence or otherwise.

This disclaimer notice is valid and automatically considered as accepted by guest/s entering the property.

Vehicles

 Vehicles and their contents are left on the premises and parked in the street in front of the premises, at the owner’s sole risk in all respects. 

Neither Cambridge House (Pty) Ltd, its owners, the Proprietor, its agent/s, contractors and/or its employee/s accepts liability for any theft or loss of, or damage, howsoever caused, to vehicles, accessories or contents incurred on, and around the premises. 

Swimming Pool Disclaimer 

Any resident, guest or their visitors using the swimming pool and surrounding area are utilising such facilities entirely at their own risk and that they are fully aware that there are no lifesaving facilities of any nature provided, and that there is not a safety net over the swimming pool, and therefore indemnify Cambridge House (Pty) Ltd, its owners, the Proprietor, its agent/s, contractors and/or its employee/s, in full and shall have no claim of whatsoever nature against Cambridge House (Pty) Ltd, its owners, the Proprietor, its agent/s, contractors and/or its employee/s, including any claim from any injury/ bodily harm/death and or/loss of property which could arise from the use of this facility, including the swimming pool. 

No children are allowed in the swimming pool area without adult supervision. No children are allowed to swim without adult supervision.

No-one is allowed to swim alone, there must be another person present.

No swimming is permitted after sunset. 

Ramps & Stairs

Please use Caution when using the walking ramps on the property

Please hold onto the handrail when you walk on the ramp.

Cambridge House (Pty) Ltd, its owners, the Proprietor, its agent/s, contractors and/or its employee/s shall not be liable for any claims of whatever nature including but not limited to theft, injury, loss or damage of whatever nature, including injury sustained when using our walking ramps.

 

The residents, guest/s and other people entering the premises, in addition to the aforesaid, hereby indemnify, waive/s and abandon/s any claims of whatever nature against Cambridge House (Pty) Ltd, its owners, the Proprietor, its agent/s, contractors and/or its employee/s for any claims which may arise from whatever nature, whether arising from their default, negligence or otherwise.
